Privacy policy and terms of service

NClude Inc. (“NClude,” “we,” “us”) is a 501(c)(3) nonprofit organization headquartered in Bellevue, Washington, USA. This page explains what information we collect when you use our website and platform, how we use and protect it, and the terms that apply when you use our services. If you do not agree with this policy or these terms, do not use our services.
Information we collect
Account information. When you register, we may ask for your name, email address, phone number, and similar details.
Disability-related information. Some programs ask about your disability, and in some cases for documentation, to determine eligibility, personalize support, or recommend services. This is sensitive information. We collect it only when a specific program requires it, we ask for your explicit consent when we do, access is restricted to a small number of trained staff bound by confidentiality, and it is stored securely. Basic platform services do not require it. You can ask us to update or delete this information at any time by emailing team@nclude.ai, and we will comply within 30 days.
Uploaded content. You may upload documents, audio, or video for accessibility conversion, or supporting documents such as resumes for specific programs.
Usage and log data. Our systems automatically log technical information such as IP address, browser type, pages visited, and timestamps. We use this to keep the service secure, fix problems, and understand usage. It is not used for advertising.
How we use information
We use your information to provide, operate, and improve our services; personalize your experience; recommend relevant programs, jobs, and benefits information; communicate with you about the services; and detect and prevent fraud and abuse. We do not sell personal information and we do not show advertising.
Uploaded content
For accessibility conversion, we may use uploaded documents and their conversions to improve our models by default. To opt out, email team@nclude.ai; we will process your content and then discard it, and we can apply that choice to all future uploads. Institutional administrators may request deletion of processed content for their organization. When content is deleted after processing, we cannot provide escalation or re-review for that content. Content uploaded for other programs is stored securely and used only for that program.
When we share information
With partners who help deliver programs. Some programs are run with partner organizations. Partners receive only the information needed for that program, are bound by confidentiality obligations consistent with this policy, and may use the information only for that program. We tell you when a program involves a partner and how the partner will use your data.
When the law requires it. We may disclose information in response to valid legal process or when necessary to protect safety.
We do not sell, trade, or rent personal information.
Because we operate in more than one country, your information may be processed outside your own country. When it is, we apply safeguards consistent with this policy and applicable data protection law.
Security
Personal information is stored on secured systems, access is limited to staff who need it, and sensitive information is encrypted in transit. No system is perfectly secure. If a data breach affects your personal information, we will notify you promptly and within the timelines required by applicable law.
Cookies
We do not use cookies for advertising or cross-site tracking, and we do not allow third-party behavioral tracking on our website. You can control cookies through your browser settings.
Children
Our services are not directed to children under 13, and we do not knowingly collect personal information from children under 13 without verifiable parental consent. Students under 18 may use our services through a school or institution under an agreement that addresses consent. If you believe a child has provided us personal information, contact team@nclude.ai and we will delete it.
Your rights
You can ask us to access the personal information we hold about you, correct it, delete it, restrict or object to how we process it, or provide a copy in a portable format. Email team@nclude.ai. We respond within 30 days, or sooner where the law requires.
California residents have these rights under the CCPA and CPRA. We do not sell or share personal information as defined in California law.
Residents of the European Economic Area and the United Kingdom. We process personal data under the GDPR and UK GDPR. Our legal bases are consent (including explicit consent for disability-related information, which is special category data), performance of services at your request, and legitimate interests in operating a nonprofit service. You may withdraw consent at any time and may lodge a complaint with your data protection authority.
Residents of India. We process personal data of users in India in accordance with the Digital Personal Data Protection Act, 2023.
Changes to this policy
When we make material changes, we will post the updated policy here with a new effective date and, for significant changes, notify registered users by email.
Terms of service
The service. NClude’s services are provided as is. We do not guarantee uninterrupted or error-free operation, and we are not responsible for indirect losses related to use of the services, including community services. Do your own diligence on advice received from community members.
Information, not advice. Content on our services, including benefits, career, and program information, is general information. It is not legal, financial, medical, or benefits advice. Confirm details with the relevant agency or a qualified professional before making decisions.
Your content. You keep ownership of anything you upload. You confirm you have the rights to upload it, and you give us the permission needed to process it for the purposes described in this policy.
Acceptable use. Do not use the services to break the law, infringe others’ rights, upload malicious code, or attempt to disrupt or gain unauthorized access to our systems.
Individual and institutional use. A subset of NClude services is free for individuals for personal, non-commercial use. Use by or through an institution, such as a school, organization, association, or employer, requires a service agreement with NClude unless an NClude officer confirms otherwise in writing. This includes making the service available to students, clients, employees, members, or alumni, and organized instruction of such groups in using the service. Institutions should contact team@nclude.ai.
Pricing. Automated services have pricing published on our website. For manual services such as remediation or manual testing, we provide a written quotation, and work begins after both parties sign an agreement.
Refunds. Because our services are digital, we cannot offer refunds once you have begun using a service. If you have not started using the service, we will provide a full refund.
Governing law. These terms are governed by the laws of the State of Delaware, USA.
